Terms of Service

Please read these terms carefully before using The Salon Suite.

The Salon Suite is a business-to-business service designed for salon professionals and other business users. By creating an Account, you confirm that you are acting in the course of a business, trade or profession. For certain micro-business or sole trader users, you may still have statutory consumer rights under the laws of England and Wales; where this is the case, nothing in these Terms affects those rights.

1. Definitions

In these Terms of Service ("Terms"), the following definitions apply:

  • "Service" means the web-based salon management application known as The Salon Suite, accessible at thesalonsuite.uk, including all features, tools, calculators and related services.
  • "We", "Us", "Our" means [Company Name], a company registered in England and Wales, operating The Salon Suite.
  • "User", "You", "Your" means any individual or entity that registers for, accesses, or uses the Service, including salon owners, managers and authorised staff members.
  • "Salon" means the hair, beauty or barbering business operated by the User that is managed through the Service.
  • "Client Data" means any personal data relating to the User's salon clients that is entered into, stored within, or processed by the Service, including but not limited to names, contact details, appointment history, colour formulas, consultation records and notes.
  • "Account" means the registered account created by a User to access the Service.
  • "Subscription" means the paid plan selected by the User granting ongoing access to the Service.
  • "Calculator Tools" means the colour calculation, pricing, product quantity estimation and business analysis tools provided within the Service.
  • "Content" means all text, images, graphics, software, source code, designs and other materials that form part of the Service itself (excluding User-submitted data).

2. Account Registration & Responsibilities

2.1. To use the Service, you must create an Account by providing accurate and complete information, including your name, email address and salon details.

2.2. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under the laws of England and Wales.

2.3. You are responsible for maintaining the confidentiality of your login credentials. You must not share your Account with any person outside your salon, nor allow others to access the Service using your credentials unless they are authorised staff members within your salon.

2.4. You are responsible for all activity that occurs under your Account. You must notify us immediately at hello@thesalonsuite.uk if you become aware of any unauthorised use of your Account.

2.5. You agree to keep your Account information up to date. We may use the email address associated with your Account to send important service notifications, billing communications and, where you have consented, marketing communications.

2.6. We reserve the right to refuse registration, suspend or terminate any Account at our sole discretion where we reasonably believe these Terms are being breached.

3. Free Trial

3.1. We offer a free trial period of fourteen (14) calendar days from the date of Account registration (the "Trial Period").

3.2. No credit card or payment information is required to start a Trial Period. You will have access to the full functionality of the Service during the Trial Period.

3.3. At the end of the Trial Period, your access to the Service will be restricted unless you subscribe to a paid plan. Your data will be retained for a period of thirty (30) days following the expiry of the Trial Period, after which it may be permanently deleted.

3.4. We reserve the right to modify or discontinue the Trial Period at any time, including changing its duration or the features available. Any such changes will not affect trials already in progress.

3.5. The Trial Period is limited to one per salon. Attempts to create multiple accounts to obtain additional free trials constitute a breach of these Terms.

4. Subscription Terms

4.1. Following the Trial Period, continued access to the Service requires an active paid Subscription. We offer the following plans:

  • Monthly Plan: Billed monthly on a rolling basis.
  • Annual Plan: Billed once per year at a discounted rate.

4.2. Current pricing is displayed on our website at thesalonsuite.uk. All prices are stated in pounds sterling (GBP) and are inclusive of VAT where applicable.

4.3. Subscriptions automatically renew at the end of each billing period (monthly or annually, as applicable) unless cancelled by you before the renewal date.

4.4. We may change our pricing at any time. If we increase prices, we will provide you with at least thirty (30) days' written notice via email before the new price takes effect. If you do not agree to the new price, you may cancel your Subscription before the next billing cycle.

4.5. Downgrading, upgrading or changing billing frequency (monthly to annual or vice versa) will take effect at the start of your next billing period. Any price difference for upgrades during a billing period will be calculated on a pro-rata basis.

5. Payment Terms

5.1. All payments are processed securely by Stripe, Inc. ("Stripe"), our third-party payment processor. By subscribing, you agree to Stripe's terms of service.

5.2. We do not store your full credit or debit card details on our servers. Card information is collected, processed and stored directly by Stripe in accordance with Payment Card Industry Data Security Standards (PCI DSS).

5.3. You authorise us to charge your designated payment method for recurring subscription fees. It is your responsibility to ensure that your payment method is valid and has sufficient funds.

5.4. If a payment fails, we will notify you by email and provide a reasonable grace period (typically seven days) in which to update your payment details. If payment is not received within this period, your access to the Service may be suspended until the outstanding balance is settled.

5.5. All fees are non-refundable except as expressly stated in Section 6 (Cancellation & Refund Policy) of these Terms, or where required by applicable law.

6. Cancellation & Refund Policy

6.1. Your Right to Cancel (Cooling-Off Period)

Under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your Subscription within fourteen (14) days of the date on which you first subscribe to a paid plan, without giving any reason. This cooling-off period does not apply to free trials.

To exercise this right, you must inform us of your decision to cancel by sending a clear statement to hello@thesalonsuite.uk within the 14-day period. Upon receiving your cancellation request, we will issue a full refund of any Subscription fees paid, processed to your original payment method within fourteen (14) days.

6.2. Cancellation After the Cooling-Off Period

You may cancel your Subscription at any time by navigating to Settings > Billing within the Service, or by contacting us at hello@thesalonsuite.uk.

  • Monthly Plans: Cancellation takes effect at the end of your current monthly billing period. You will retain access to the Service until that date. No refund is provided for the remainder of the current billing period.
  • Annual Plans: If you cancel an annual plan after the 14-day cooling-off period, you may request a pro-rata refund for any full, unused months remaining on your plan. Pro-rata refunds are calculated based on the monthly equivalent of your annual fee. Refunds are issued within fourteen (14) days of the request.

6.3. Data After Cancellation

Following cancellation, your data will be retained in a read-only state for thirty (30) days, during which you may export your data. After this period, all data associated with your Account may be permanently deleted in accordance with our Privacy Policy.

6.4. Refund Requests

All refund requests should be directed to hello@thesalonsuite.uk. We will acknowledge refund requests within two (2) business days and process approved refunds within fourteen (14) days.

7. Data Ownership

7.1. Your Data belongs to you. All data you enter into the Service — including Client Data, appointment records, colour formulas, consultation records, financial data and any other information — remains your property at all times.

7.2. By using the Service, you grant us a limited, non-exclusive licence to process, store and transmit your data solely for the purpose of providing and improving the Service. We will not sell, rent, share or otherwise disclose your data to third parties except as set out in our Privacy Policy or as required by law.

7.3. Where Client Data constitutes personal data under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, you are the data controller and we are the data processor. The terms of this arrangement are set out in our Data Processing Agreement.

7.4. You may export your data at any time using the export functions available within the Service. Upon termination of your Account, you have thirty (30) days to export your data before it may be permanently deleted.

8. Acceptable Use

8.1. You agree to use the Service only for its intended purpose: managing your salon business operations. You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations, including data protection legislation.
  • Share your Account credentials with individuals outside your salon or allow third parties to access the Service through your Account without authorisation.
  • Attempt to scrape, extract, copy, reverse-engineer, decompile or disassemble any part of the Service or its underlying software.
  • Use automated scripts, bots or other programmatic means to access or interact with the Service without our prior written consent.
  • Upload, transmit or store any material that is malicious, harmful, defamatory, obscene, or otherwise objectionable.
  • Attempt to gain unauthorised access to any part of the Service, other Users' accounts, or our servers and infrastructure.
  • Use the Service to send unsolicited marketing communications (spam) to salon clients without their consent, in breach of the Privacy and Electronic Communications Regulations 2003 (PECR).
  • Resell, sublicence or redistribute access to the Service without our express written consent.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.

8.2. We reserve the right to investigate any suspected breach of this Section and to suspend or terminate your Account if, in our reasonable judgement, a breach has occurred.

9. Intellectual Property

9.1. The Service, including all software, source code, algorithms, designs, graphics, user interface elements, documentation, trade marks (including "The Salon Suite" name and logo) and other Content, is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws of England and Wales and international treaties.

9.2. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the duration of your Subscription solely for the purpose of managing your salon business.

9.3. Your data, Client Data, colour formulas, consultation records and any other information you enter into the Service remains your intellectual property. We claim no ownership rights over your data.

9.4. You may not copy, modify, distribute, sell or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the Service, except where such restriction is prohibited by applicable law.

10. Service Availability & SLA

10.1. We aim to maintain Service availability of 99.9% uptime, measured on a monthly basis. This target is an objective, not a guarantee.

10.2. We may occasionally need to perform scheduled maintenance, during which the Service may be temporarily unavailable. We will endeavour to provide at least twenty-four (24) hours' advance notice of planned maintenance via email or an in-app notification, and we will schedule maintenance during low-usage periods (typically between 01:00 and 05:00 GMT) wherever reasonably possible.

10.3. The uptime target excludes: (a) scheduled maintenance periods; (b) force majeure events beyond our reasonable control; (c) issues arising from your internet connection, device, browser or third-party services; (d) periods of unavailability caused by your actions or breach of these Terms.

10.4. In the event of unplanned downtime exceeding four (4) consecutive hours, we will publish a status update on our website and notify affected Users by email as soon as reasonably practicable.

10.5. We do not guarantee that the Service will be uninterrupted, error-free, or free from vulnerabilities. We will use commercially reasonable efforts to resolve any issues promptly.

11. Limitation of Liability

11.1. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under the laws of England and Wales.

11.2. Subject to clause 11.1, our total aggregate liability to you arising out of or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the total fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.

11.3. Subject to clause 11.1, we shall not be liable to you for any: (a) indirect, incidental, special, consequential or punitive damages; (b) loss of profits, revenue, business, anticipated savings, goodwill or opportunity; (c) loss or corruption of data (except to the extent caused by our gross negligence); (d) losses arising from business decisions made using the Service, including decisions based on outputs from the Calculator Tools.

11.4. We are not liable for any failures, interruptions or errors caused by third-party services, including but not limited to Stripe (payment processing), Vercel (hosting), Supabase (database), Resend (email delivery) or Twilio (SMS delivery).

11.5. You acknowledge that the Service is designed as a business management tool and is not a substitute for professional financial, legal, accounting or regulatory advice.

12. Calculator & Tool Disclaimer

12.1. The Calculator Tools provided within the Service — including but not limited to colour mixing calculators, product quantity estimators, pricing tools, cost calculators and business analysis tools — are designed to provide estimates and indicative guidance only.

12.2. The outputs of Calculator Tools are based on the data and parameters you provide and on generalised formulas. They do not constitute professional advice of any kind, including but not limited to financial advice, chemical safety advice, or hairdressing/beauty therapy professional guidance.

12.3. You are solely responsible for: (a) verifying the accuracy of all Calculator Tool outputs before relying upon them; (b) ensuring that any colour formulas, product quantities or chemical mixtures are safe and appropriate for use on individual clients, taking into account allergies, sensitivities, hair condition and other relevant factors; (c) conducting appropriate allergy and sensitivity testing (such as patch tests) before applying any products to clients, regardless of any output provided by the Service.

12.4. We make no representation or warranty that the outputs of Calculator Tools will be accurate, complete, reliable or suitable for any particular purpose. To the maximum extent permitted by law, we disclaim all liability arising from reliance on Calculator Tool outputs.

12.5. Any pricing estimates generated by the Service are for guidance only. You are responsible for setting your own prices and ensuring they comply with consumer protection legislation, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

13. Indemnification

13.1. You agree to indemnify, defend and hold harmless The Salon Suite, its directors, officers, employees, agents and licensors from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Service; or (c) your unlawful processing of Client Data in breach of applicable data protection laws.

13.2. This indemnity shall survive the termination of these Terms and your Account.

14. Termination

14.1. Termination by you: You may terminate your Account and these Terms at any time by cancelling your Subscription through Settings > Billing within the Service, or by emailing hello@thesalonsuite.uk. Cancellation and refund terms are set out in Section 6.

14.2. Termination by us: We may suspend or terminate your Account and access to the Service immediately, without prior notice, if:

  • You materially breach these Terms and fail to remedy the breach within fourteen (14) days of receiving written notice;
  • You commit a serious or repeated breach of the Acceptable Use policy set out in Section 8;
  • Your use of the Service poses a security risk to us or other Users;
  • We are required to do so by law, regulation or a court order;
  • Your Account has been inactive for more than twelve (12) consecutive months.

14.3. Effect of termination: Upon termination, your right to access the Service will cease immediately (subject to any applicable notice period). Sections of these Terms that by their nature should survive termination will continue to apply, including Sections 7 (Data Ownership), 9 (Intellectual Property), 11 (Limitation of Liability), 12 (Calculator Disclaimer), 13 (Indemnification) and 16 (Governing Law).

14.4. We will retain your data for thirty (30) days following termination to allow you to export it. After this period, all data will be permanently deleted in accordance with our Privacy Policy and Data Processing Agreement.

15. Changes to These Terms

15.1. We may update these Terms from time to time to reflect changes in our Service, legal requirements or business practices.

15.2. We will provide you with at least thirty (30) days' advance notice of any material changes to these Terms by sending a notification to the email address associated with your Account.

15.3. The updated Terms will also be published on this page with a revised "Last updated" date.

15.4. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your Subscription before the changes take effect.

16. Governing Law

16.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

16.2. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16.3. If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

17. Dispute Resolution

17.1. If you have a complaint or dispute regarding the Service, we encourage you to contact us first at hello@thesalonsuite.uk so that we can attempt to resolve the matter informally.

17.2. We will acknowledge your complaint within two (2) business days and aim to provide a substantive response within fourteen (14) days.

17.3. If we are unable to resolve the dispute informally within thirty (30) days, either party may pursue the matter through the courts of England and Wales as set out in Section 16.

17.4. For EU/UK consumers, you may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, although please note that the UK's participation in this platform may be subject to change following Brexit.
